About "Adwity": Adwity is a platform owned by Adwity for Information Technology, a limited liability company (LLC) subject to the provisions of Investment Law No. 72 of 2017. The platform includes a website and mobile application operating on Android and iOS systems, hereinafter referred to as "Adwity / the Platform". Adwity has a website and mobile application for ordering all user needs from licensed pharmacies, whether medicines, non-drug products, online - medical supplies, vitamins, dietary supplements, cosmetics, accessories, skincare, and hair care products, etc., hereinafter referred to as "Products". Adwity directs the digital and/or electronic order and sends it to the nearest licensed pharmacy through its network of contracted pharmacies across the Arab Republic of Egypt. The pharmacy prepares the order and delivers it to the customer's home as per their preference, either through pharmacy delivery agents or through shipping companies contracted by the pharmacy, after verifying the prescription from a doctor where required. Adwity reviews all listed pharmacies to verify their licenses and eligibility to provide the required services under its responsibility.
Terms and Conditions: The terms and conditions specified below, in addition to the privacy policy, constitute a binding agreement between the user and Adwity when using all its services. Therefore, please read them carefully as they clarify the rules governing the platform and the rights and obligations of the platform's users – including individuals and licensed pharmacies listed on the platform (referred to collectively as "Users" and individually as "User"). Adwity may amend the terms and conditions at any time at its absolute discretion without the need to notify users. Accordingly, users are required to periodically review the platform and comply with all updated terms and conditions. By registering on the platform, the user explicitly acknowledges reading, understanding, and accepting the terms and conditions, which are effective against the user. If the user does not agree to the terms and conditions or any future modifications thereof, or any part thereof, the user must not register on the platform or, if already registered, should withdraw from the platform at the time the user rejects the modification.
Privacy Policy: By registering on the platform, the user agrees, in addition to the mentioned terms and conditions, to the privacy policy and cookie policy.
Registration on the Platform: To benefit from our services, the user must register on the platform – create a new account – by entering their personal data, including but not limited to their name, email address, and phone number. The user commits to providing accurate and complete information when creating the account and is responsible for updating and modifying it as necessary. After creating the account, the user is fully responsible for maintaining their username and chosen password. Consequently, the user bears full responsibility for any activities carried out using their username and password. Adwity disclaims any legal liability related to the use of the user's account and explicitly disclaims any obligation in this regard. If someone gains access to the user's account and password, Adwity will assume that it is indeed the user. The user alone is responsible for any access to the platform or use of the service by anyone using their username and password or any payments made using their username and password. Therefore, the user should immediately notify Adwity if they suspect any unauthorized party is using their account, and for their security and privacy, they should contact us at the following email address: info@adwityapp.com for user support to recover their account and reset their password.
Service Notifications: User registration on the platform constitutes explicit consent to receive necessary notifications and text messages from Adwity to efficiently provide the service, including service updates, as well as to communicate regarding satisfaction surveys related to service quality via email or registered phone number.
Product Pricing: All products are priced in the local currency of the country, and Adwity reserves the right to change and update prices at any time as requested by the pharmacies marketing the displayed products. Product pricing is based on the pharmacies listed on the platform sending a list of approved and licensed medicines and medical supplies at market-accepted prices, which are regularly and continuously updated by the listed pharmacies.
Payment Methods: The price of products listed on the platform can be paid for through either of the following methods:
Delivery of Products: The pharmacy listed on the platform, to which the order is digitally/electronically sent, prepares and delivers it to the user's home as per their preference. This is done either through pharmacy delivery agents or through shipping companies contracted by the pharmacy, after verifying the prescription from a doctor where required. The products are delivered to the address specified by the user. Products are delivered to the front door of private residences or to reception desks if delivered to the user's workplace. The pharmacy is responsible for providing the user with an invoice for their order upon delivery. Adwity reserves the right to share the user's address, phone number, and other required information with pharmacies executing their orders for order fulfillment and customer relationship management purposes.
Cancellation by Adwity: Adwity reserves the right to cancel the user's order in situations beyond its control, such as the user providing an incorrect address, the recipient not being present at the specified address, lack of access permission, bad weather, or any similar circumstances that prevent or complicate delivery, or unavailability of all or some of the products. In such cases, the user is not entitled to claim any compensation or monetary substitute in any form. If payment was made online, Adwity will refund the money promptly upon order cancellation, and thereafter, it is the responsibility of the bank to transfer the amount to the user's account within 3 to 5 working days.
Modification and Cancellation by the User: The user may not be able to modify their order after confirmation due to the technical and operational features of the service. However, they can cancel the order within a specified timeframe until it is processed for delivery and then delivered to the user.
Disclaimer: Under these terms and conditions, the user acknowledges that Adwity is a technology company providing technological solutions to facilitate users' orders for all their needs from licensed pharmacies, whether medicines or non-drug products online. All products available on the website and application, including medicines and others, are owned by the pharmacies listed on the platform. These products are dispensed from pharmacies licensed by the Ministry of Health, with a valid medical prescription from a specialist where required. Therefore, Adwity bears no responsibility for:
Based on this, Adwity does not assume any responsibility for any claims, damages, or malfunctions resulting from the actions or errors of pharmacies listed on the platform. In case of any dispute with a pharmacy, the user agrees to release Adwity, its officers, directors, employees, subsidiaries, and affiliated companies from any claims and costs, including attorney fees and compensation for loss or damage, known or unknown, related to such disputes.
Civil and criminal liability lies with the pharmacies listed on the platform and their employees for their professional errors in case of dispensing medication not specified in the medical prescription, whether due to error, negligence, or providing an alternative medication without the user's knowledge or consent or without consulting the treating physician. The pharmacy and its employees are fully responsible for thoroughly checking and reading the medical prescription before dispensing it, verifying all its data, and recording dosage schedules, quantities, and days of medication intake. The pharmacy and its employees are also responsible for all medications available, including controlled substances listed in the schedules specified by the Minister of Health under the narcotics law.
However, the pharmacy should not be questioned about the ineffectiveness of the prescribed treatment as long as it has actually been delivered to the patient/user, unless the ineffectiveness is due to the medication being compromised or the preparation being expired due to improper storage, or unless there is an official decision from the competent authorities (Ministry of Health) to cease production and withdraw the medication from pharmacies.
User Prohibitions:
Control of the Platform by Adwity:
Adwity reserves the full right to control the use of the platform by any or all users, in order to strengthen and protect the platform from any harm that may arise from such use. Adwity control over the platform may include the following means:
Non-competition: Users are prohibited from using the platform to build platforms or provide services similar to those offered by Adwity.
Intellectual Property: The user acknowledges Adwity's ownership of all intellectual property rights as defined in Intellectual Property Law No. 82 of 2002, whether registered, registrable, or unregistered. This includes software, applications, designs, codes, data, information, publications, and content on the platform. Adwity has the right to use, exploit, or deal with these rights in any manner deemed appropriate, and the user waives any right to intervene or object to Adwity's exercise of these intellectual property rights.
Indemnification: The user agrees to defend and indemnify Adwity, its directors, employees, partners, agents, representatives, and other users against any and all claims, damages, liabilities, losses, costs, debts, and expenses arising from the user's actions or failure to act.
Links to Other Websites: The platform may contain links to external websites not owned or managed by Adwity. Adwity bears no responsibility for these websites, their contents, or the services they offer. Users are advised to carefully read the terms and conditions of all other websites before using or registering with them. The user guarantees that Adwity will not be directly or indirectly liable for any claims, disputes, losses, or damages arising from the user's use of other websites, their contents, or the services provided.
Termination by Adwity: Adwity reserves the right to terminate a user's account without prior notice if the user violates the terms and conditions, especially the clauses on user prohibitions, platform control by Adwity, and non-competition. Adwity also reserves the right to terminate the user's account if there is suspicion regarding the legality of the user's activities or identity.
Termination by the User: Users may terminate the receipt of services provided by Adwity by deleting their user account. In this case, Adwity reserves the right, without prior notice or consent from the user, to store and retain the user's data for archival purposes.
Notes and Comments: If any user provides Adwity with any comments, suggestions, recommendations, improvements, feature requests, information, or materials related to the platform, its content, or services ("Feedback"), Adwity will treat such Feedback as non-confidential and proprietary. By providing Feedback to Adwity, the user grants Adwity a perpetual, irrevocable, non-exclusive, royalty-free license to use, copy, reproduce, modify, display, distribute, adapt, create derivative works of, and exploit such Feedback in any manner Adwity sees fit.
Severability: If any provision or clause of the above terms and conditions is deemed unlawful, void, or unenforceable, it shall not affect the legality, validity, or enforceability of the remaining provisions, which shall remain valid and enforceable.
Comprehensiveness of Terms and Conditions: The terms and conditions, along with the privacy policy and cookie policy, constitute the entire agreement between Adwity and the user(s).
Applicable Law and Jurisdiction: The terms and conditions, and any matters related to or arising from them, are governed by the laws of Egypt and fall under the jurisdiction of the Egyptian courts.
